Terms of Service

1. Agreement and eligibility

These Terms govern your use of the DriverMod app and related services provided by Gaijin Motorsports LLC ("we", "us", "our"). By creating an account or using DriverMod, you agree to these Terms and to our Privacy Policy. You must be at least 18 years old to use DriverMod.

2. The service

DriverMod records driving telemetry and provides lap timing, session analysis and AI-generated coaching. These are educational and informational tools only. They are not driving instruction and not safety equipment.

The liability waiver below is the same waiver you accept in the app before first use. By using DriverMod, you acknowledge and agree to the following:

3. Accounts

Each account is for one person. Keep your sign-in credentials secure; you are responsible for activity under your account. We may suspend or terminate accounts involved in abuse, fraud or violations of these Terms.

4. Subscriptions (DriverMod Pro)

• DriverMod Pro is an auto-renewable subscription purchased through the App Store. Prices are shown in the app, in your local currency, before you purchase.
• Your subscription renews automatically at the end of each period (monthly or yearly) unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the end of the current period.
• Manage or cancel your subscription in iOS Settings → Apple ID → Subscriptions. Apple handles billing and refunds under its own terms.
• Free tier limits and Pro features may change. We will announce material changes in the app.
• Unlimited coaching is subject to a fair-use cap to prevent automated abuse.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile or attempt to extract the source code of the app or its services, except where the law allows it.
• Scrape, harvest or bulk-download data from the service.
• Resell or redistribute data obtained from the service.
• Use the app to break any law or to endanger others.

6. Your content

You own your telemetry, video and setup data. You grant us a limited, non-exclusive licence to store and process that content only as needed to provide the service to you.

7. Intellectual property

DriverMod, Ryosuke, Gaijin Motorsports and the related names, logos and marks belong to Gaijin Motorsports LLC. Vehicle reference data is provided under licence from Carfolio; attribution is shown in the app.

8. Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind. We do not guarantee the accuracy of lap times, telemetry or coaching. GPS and motion sensors have inherent limitations, and results depend on your device, mounting and conditions.

To the fullest extent permitted by law, Gaijin Motorsports LLC will not be liable for any indirect, incidental, special or consequential damages, and our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.

9. Termination

You may stop using DriverMod and delete your account at any time. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination, including the liability waiver, disclaimers and limitation of liability, will survive.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida.

11. Changes to these terms

We may update these Terms. We will update the "Last updated" date above and announce material changes in the app. Continuing to use DriverMod after changes take effect means you accept them.
